Justin Demerath is the managing partner of the firm’s contingent fee litigation department focusing on mass tort, product liability, first party insurance, personal injury, pharmaceutical, and medical device litigation.
Justin received his Bachelor of Business Administration in Finance from Southern Methodist University. He then went on to obtain his Juris Doctorate degree from Southern Methodist University’s School of Law, and also attended the University of Texas School of Law as a visiting student. During his undergraduate studies, Justin received instruction at University College at Oxford University, Oxford, England. He also studied abroad at the University of Sydney Law Facility in Sydney, Australia.
Justin discovered his passion for the law and the value of a dedicated work ethic at an early age while growing up working in agriculture in Nebraska, where he participated in all aspects of the family corn farming operation each summer with his father, Larry Demerath, who is also an attorney. Justin additionally worked as a law clerk for his father’s law firm while attending Brownell Talbot, a college preparatory high school in Omaha. Justin has spent his legal career advocating and litigating on the behalf of people who have suffered damage and has brought accountability upon entities that have caused trauma and loss to others.
As a husband, primary breadwinner, and father of two, Justin understands the impact that a life-shattering event can have on a family or business. He handles every case with the same level of compassion and allegiance to the welfare of the plaintiff as he would his own loved ones. Over the many years of his law practice, Justin has proven to his clients, juries, and the corporate defendants he prevails against, that every case will receive his personal attention and his assurance that no stone will be left unturned, no matter how complex the case may be.
Mr. Demerath was recently selected by his peers to serve as the President of the Capital Area Trial Lawyers Association, a local Austin area organization founded to promote the public’s right of unrestricted access to the courts and the jury system and to facilitate the exchange of knowledge and resources among contingent fee lawyers. He also serves as the Vice President of Legislative Affairs and Executive Committee member of the Texas Trial Lawyers Association, a state wide organization with a similar purpose.
He is a member of State Bar of Texas, The State Bar of Nebraska, The State Bar of Colorado, The American Association of Justice (formerly Association of Trial Lawyers of America), Texas Trial Lawyers Association, Nebraska Trial Lawyers Association, Capital Area Trial Lawyers Association, and the Aircraft Owners and Pilots Association.
Syngenta GMO Corn Litigation
Served as a team member representing thousands of midwestern corn farmers in litigation against a multinational biotech company that prematurely marketed GMO corn seed prior to foreign government approval which resulted in the closure of the Chinese market to US Corn Exports and cost US Corn Farmers Billions in lost profits.
Prosecuted a case against a fortune 500 equipment manufacturer that created a commercial lawnmower that was unable to be operated as advertised and caused grievous injury to the operator.
Car, Trucking and Motorcycle Accidents
Advocated for many truck and automobile wreck victims and their families to receive full and appropriate compensation for injures cased by negligent drivers and trucking companies.
Sutherland Springs Shooting
Represented approximately 25% of the individuals and families harmed in the Sutherland Springs Church Shooting in a bid to be compensated by the Air Force due to their failure to report the shooters criminal history, a violation of federal law which led to the ability of the legally and mentally incompetent shooter to acquire the firearms used in the massacre.
NFL Concussion Litigation
Advocated for a group of former NFL players’ families in their bid to be included in the NFL Concussion Settlement after obtaining a diagnosis of CTE.
First Party Insurance
Presented and litigated first party insurance claims for large commercial entities, such as School Districts and The Circuit of Americas Formula One Racetrack in an effort to make a full recovery after flood, hail and hurricane damage.
GM Ignition Switch Litigation
Served as a team member representing a group of over 130 individuals who were harmed in automobile accidents in a multitude of General Motors Vehicles due to faulty ignition switches, which could shut off the engine during normal driving conditions and thereby prevent the airbags from inflating in an accident.
